Terms and Conditions
The terms of use and the contractual basis for using Momentum.
Last updated: October 27, 2026
1. Scope and provider
These terms govern the use of the Momentum app. The provider is [NAME], [ADDRESS], reachable at support@muscle-vision.de. Momentum is a training and nutrition app: you log workouts, manage training plans, track body measurements and keep a food diary. Terms of your own do not become part of the contract unless the provider agrees to them expressly. You must be at least 16 years old to use Momentum.
2. Where your data lives
Momentum works on your device first. Training, nutrition and body data are stored locally, and the app is fully usable without an internet connection. Without an account, that data never leaves your device. If you create an account, your data is additionally synchronised with the provider's server infrastructure so that it is available on more than one device and survives changing phones. Which processors are involved and where they process is set out in the privacy policy. For data that exists only locally on your device, the provider performs no backup. If the device is lost, that data is lost. You can produce a complete export of your data yourself at any time inside the app.
3. Momentum Pro: conclusion of contract, term and trial
Using Momentum requires an active subscription. Offered are a monthly subscription and a yearly subscription. The purchase is concluded exclusively through Apple's App Store or through Google Play. The contractual partner for payment, invoicing and management of the subscription is therefore the respective store operator and not the provider; their terms take precedence over these terms for the payment itself. Subscriptions renew automatically for the chosen term unless cancelled at least 24 hours before the end of the current period through the account settings in the App Store or Google Play. Cancellation happens there and not in the app. New customers may start the yearly subscription with a free seven-day trial. If it is not cancelled in time, the trial converts automatically into the chosen paid subscription. The prices in force are shown in the store before the purchase.
4. Withdrawal and refunds
Because the purchase is concluded through the App Store or Google Play, withdrawal and refunds follow the terms of the respective store operator, and requests must be made there. The provider cannot refund payments it never received. Where a statutory right of withdrawal exists against the provider, it lapses for digital content once you have expressly consented to immediate performance and have acknowledged that you thereby lose that right.
5. Your obligations
You may not use the app to distribute unlawful content. Content you make visible to others — shared training plans, what your friends see of your profile, entries in the shared food catalogue — must not infringe the rights of third parties. The provider may remove such content upon a substantiated notice of an infringement. You are responsible for keeping your account credentials confidential.
6. Availability
The app is usable offline. Features that require a connection — synchronisation between devices, sharing content, meal photo analysis and searching the shared food catalogue — depend on those services being reachable. No particular availability of these services is owed. Maintenance and outages are possible.
7. Not medical advice
Using the plans and recommendations offered, and the evaluation of your training data, is at your own responsibility. Momentum is not a medical device and replaces neither medical advice nor physiotherapeutic care. Nutritional values come from public and user-maintained data sources and may be incomplete or wrong. Please consult a doctor before beginning an intensive training programme or changing your diet, particularly if you have pre-existing conditions.
8. Liability
The provider is liable without limitation for intent and gross negligence and for injury to life, body or health. For ordinary negligence the provider is liable only for breach of a material contractual obligation — one whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely — and limited in amount to the foreseeable damage typical for this type of contract. Liability is otherwise excluded. Claims under the German Product Liability Act remain unaffected.
9. Deleting your account
You can delete your account in the app at any time. Doing so deletes the personal data stored by the provider; the privacy policy sets out the details. Deleting the account does not end a running subscription. That must be cancelled separately in the App Store or Google Play.
10. Changes to these terms
The provider may propose changes to these terms where technical developments, changes to the scope of the service or legal requirements make them necessary. The provider tells you in good time what changes, in the app and, if you have an account, also by email. The changes apply only from your express agreement in the app; silence and continued use of the app do not count as agreement. If you do not agree, the previous terms continue to apply to you. Correcting typos and clarifying wording without changing your rights and obligations is not a change within the meaning of this section.
11. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection provisions of your country of residence remain unaffected. The provider is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected.
